Consent* I agree to the following:
On behalf of (company or name) I do hereby agree that the Corporation of the City of Quinte West is in no way responsible for any change to persons or property arising out of the above work and hereby undertake to save harmless and indemnify the Corporation and its employees from all suits, claims, demands, actions, damages etc. whether same shall
be with or without merit and further that any and all damages to Corporation or Utilities property on or in the Right-of-way (including roadways, curbs, boulevards, sidewalks etc.) shall be reinstated to the satisfaction of the City of Quinte West upon completion of the work and further that the area of work shall be maintained and guaranteed for a period of one year from the date of completion of the above work.
Any work within the right-of-way will be the full responsibility of the Permit Applicant until such time as the Applicant has completed the work and restored the work area according to the satisfaction of the City. Upon completion of restoration of the work area, written notice is to be provided to the City of Quinte West Public Works Department so they may arrange to inspect. Until such time as the City has completed and approved their final inspection of the restoration, the Permit Applicant agrees to accept 100% liability for any costs or claims incurred. Confirmation of acceptance of the works will be provided to the Permit Applicant in writing. It is further agreed that should emergency repairs to the work be required (as determined at the sole discretion of the city), the City of Quinte West is hereby authorized to carry out such emergency repairs or arrange for others to make repairs as are necessary for the safety of the public. Any associated costs for such repairs shall be the responsibility of the above noted applicant.
General Conditions
● Applicant’s submission must be submitted 10 business days in advance of the proposed work
● Road cut shall be backfilled utilizing unshrinkable fill.
● Applicant required to submit Traffic Control Plan – OTM Book 7.
● All grassed areas which are disturbed shall be re-sodded.
● No hard surface cuts before May 15th and after November 15th of the year.
Insurance Coverage Comprehensive general liability insurance on an occurrence basis for an amount not less than Five Million dollars ($5,000,000) for any negligent acts or omissions by the contractor relating to its obligations under this Agreement. Such insurance shall include, but is not limited to Bodily Injury and Property Damage including loss of use; personal injury; contractual liability; premises, property & operations; non-owned automobile liability, broad form property damage, owners and contractors’ protective, products and completed operations, employees as additional Insured, occurrence property damage, contingent employers liability, cross liability and severability of interest clauses. Additional Insured Such insurance shall add the Corporation of the City of Quinte West as an additional insured but only with respect to the operations of the bidder. This insurance shall be non-contributing with and apply as primary and not as excess of any insurance available to the City. Automobile liability insurance with respect to owned or leased vehicles (in excess of 30 days) used directly or indirectly in the performance of the Services covering liability for bodily injury, death and damage to property with a limit of not less than Five Million dollars ($5,000,000), inclusive for each and every loss. Cancellation, Lapse, Material Change The policies shown above will not be cancelled, permitted to lapse or materially changed unless the insurer notifies the City in writing at least thirty (30) days prior to the effective date of cancellation, expiry or change. The City reserves the right to request such higher limits of insurance or other types of policies appropriate to the work as the City may reasonably require. Proof of WSIB Coverage: The (company/name above) shall ensure that all employees, contractors, or volunteers who are providing services funded by this Agreement have WSIB coverage or have coverage under an insurance policy endorsement for Employer’s Liability and Voluntary Compensation.
Other Conditions

● Work for which this permit is being issued shall be completed within the calendar year of the permit being issued
and shall be subject to cancellation due to weather constraints. Should the permit applicant request an extension
of the permit, the City shall review the request and if approved, the conditions within this permit are subject for
re-review by the City every 12 months.
● All hard surface Cut’s shall immediately be marked with WA-22 and WA-22A signs as per OTM Book 6. The City
may require additional signage depending on site specifics. The request for additional signage must be met
within 24 hours of the City making the initial request.
● The Permit Applicant shall ensure an offset of the proposed work (i.e. utility installation or other infrastructure)
from the City’s watermains, sanitary mains, and/or storm sewers is not less than 1.5 metres. The offset shall not
be less than 1.0 metre from back of curb or structures.
● The Permit Applicant shall submit a restoration plan to the City for review. All restoration shall be completed by
the Permit Applicant at their expense.
● All cuts to hard surfaces including but not limited to asphalt, concrete, curb and gutters and sidewalks shall be
permanently repaired within seven (7) days of disturbance.
